Terms of service

1. Eligibility

You must be at least 18 years old, reside in the United States and be able to form a binding contract to purchase from us. Products are sold for personal use only, not for resale.

2. Orders and acceptance

Your order is an offer to buy. It is accepted when we dispatch the products. We may refuse, limit or cancel any order, including for suspected fraud, resale, unauthorized use of a payment method, or errors in pricing, product information or availability. If we cancel a paid order, we refund the amount charged.

3. Prices and payment

Prices are in US dollars and may change at any time. Payments are processed securely by Shopify and its payment partners. You authorize us to charge your payment method for the total shown at checkout, including applicable taxes and shipping.

4. Subscribe & Save: automatic renewal

If you choose Subscribe & Save, you agree that your subscription automatically renews and your payment method is charged the subscription price shown at checkout, plus applicable tax, at the delivery frequency you selected (for example every 30, 60 or 90 days), until you cancel.

You can skip, pause, change or cancel your subscription at any time, with no fees or minimum commitment, from your account or by emailing us. Cancellations must be made at least 24 hours before your next billing date to take effect for that cycle.

We will notify you before any change to your subscription price, and you may cancel before the change takes effect. If a payment fails, we may retry the charge or pause your subscription.

5. Offers and free gifts

Complimentary gifts and shipping offers apply while supplies last, have no cash value, may be substituted with an item of similar value, and may change or end at any time.

6. Shipping, returns and guarantee

Delivery is governed by our Shipping Policy and refunds by our Returns & 60-Day Guarantee Policy, both of which form part of these Terms.

7. Cosmetic disclaimer and safe use

Our products are cosmetics, not drugs. They are not intended to diagnose, treat, cure or prevent any disease, and statements on this site have not been evaluated by the FDA. Individual results vary; testimonials reflect individual experiences.

Read the full ingredient list before use and patch-test each product for 24 hours. Stop use if irritation occurs. Consult a physician before use if you have a skin or eye condition, known allergies, are pregnant or nursing, or are under medical care. You are responsible for checking ingredients against your own allergies.

8. Chargebacks

If you have a problem with an order, you agree to contact us first and give us 14 days to resolve it before disputing the charge with your bank. We may share your order details, tracking information and these Terms with your card issuer to respond to any dispute.

9. Reviews and content you submit

By submitting reviews, photos, videos or other content, you grant us a worldwide, royalty-free, perpetual license to use, reproduce, edit and display it, with your first name, in connection with our business. You confirm the content is truthful, your own and does not infringe anyone's rights. We may moderate or remove content at our discretion.

10. Intellectual property

All site content, including the VITA PRO-AGE name, logos, images, videos and text, is owned by or licensed to us and may not be copied or used without our written permission.

11. Disclaimers and limitation of liability

To the fullest extent permitted by law, the site and products are provided “as is” and “as available” without warranties beyond those stated in these Terms. We are not liable for indirect, incidental, special, consequential or punitive damages, or for reactions arising from failure to follow usage directions or patch-test. Our total liability for any claim relating to a product or order is limited to the amount you paid for that order. Some states do not allow certain limitations, so some of these may not apply to you.

12. Indemnity

You agree to indemnify and hold us harmless from claims arising from your misuse of the site or products, your content, or your violation of these Terms.

13. Dispute resolution: binding arbitration and class-action waiver

Before filing any claim, you agree to email us and try to resolve the dispute informally for 30 days.

If unresolved, any dispute arising out of these Terms, the site or your purchases will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small-claims court. The Federal Arbitration Act governs this section.

YOU AND WE EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN ANY CLASS, COLLECTIVE OR REPRESENTATIVE ACTION.

You may opt out of this arbitration agreement by emailing us within 30 days of your first purchase with your name and a clear statement that you opt out.

14. Governing law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules, subject to the arbitration section above.

15. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. We may update these Terms by posting a new version here; changes apply to orders placed after the update.
